Through appropriately licensed participating real estate professionals and brokerages, this coordinated approach can extend to transactions throughout the United States, subject to the requirements of the particular jurisdiction and transaction.
A probate estate, trust, or conservatorship may begin with a house and later reveal substantially more.
There may be another residence. An apartment building. A shopping center. An operating business. Equipment and machinery. An ownership interest in an LLC or partnership. Depending on the matter, one professional may provide multiple applicable capabilities, or 833PROBAID® may coordinate additional specialists when different expertise, licensing, location, or transaction requirements call for it.
The distinction is straightforward.
If the client, fiduciary, receiver, business owner, investor, or legal counsel needs a business, commercial property, equipment, ownership interest, intangible asset, or other complex holding professionally valued — but there is no present decision to sell or liquidate it — 833PROBAID® can connect the client with an appropriate qualified professional.
The client, fiduciary, or legal counsel then engages that professional separately under the professional's own agreement and fee arrangement.
That is a separate professional engagement.
833PROBAID® does not become part of the valuation engagement simply because we made the introduction.
If that asset requires specialized valuation or analysis and will also be marketed, SOLD, or liquidated, the structure changes.
The appropriate qualified professional can provide the applicable valuation or specialized expertise, and that professional and/or an appropriately licensed participating brokerage, when applicable, may participate in the disposition transaction alongside 833PROBAID®.
This allows the specialized analysis, valuation, positioning, marketing, brokerage, and disposition strategy to work together as part of the transaction rather than forcing the client to assemble a new team after the valuation is completed.
Depending on the asset and transaction, this could involve a substantial apartment building, specialized commercial property, operating business, LLC or partnership interest, minority ownership position, equipment, machinery, or another complex asset being SOLD or liquidated.
If only the specialized service is needed, the appropriate professional is separately engaged. If the asset also needs to be SOLD or liquidated, 833PROBAID® can coordinate the appropriate professionals and, when applicable, participating brokerages as part of the broader disposition transaction.
The professional network available through 833PROBAID® brings experience extending beyond conventional residential or commercial brokerage.
Depending on the matter, participating professionals may bring experience in business valuation, commercial brokerage, business brokerage, asset disposition, equipment and machinery valuation, litigation support, and other specialized disciplines.
Participating professionals may also include individuals with experience serving as a court-appointed partition referee, providing additional experience involving sophisticated real property, fractional and disputed ownership, valuation, and court-related matters.
833PROBAID® does not appoint partition referees, does not act as a partition referee, and does not represent that any participating professional will serve in that capacity in a particular matter. A partition referee serves in that role only when appointed by the court.
The significance is the depth of experience available when a transaction or matter becomes substantially more complicated than the sale of a residence.
